TERMS OF SALE

1. ORDERING & ACCEPTANCE

To place an order, you must provide complete and accurate information, including your full name, shipping and billing address (P.O. Boxes are not accepted), telephone number, and a valid email address.

• Accuracy: Tom Meinelt Photography is not responsible for misdelivery resulting from inaccurate customer-provided information.

• Right to Refuse: We retain the right to reject or cancel any order at our discretion. If an order is canceled by us after payment, your sole recourse is a full refund of the payment made for that specific order.

2. CHANGES & CANCELLATIONS

• Custom Nature: All works are custom-produced to order, and production begins immediately upon purchase. Consequently, orders cannot be canceled, returned, or refunded.

• Modifications: Once an order is placed, modifications are generally not possible. Address changes are only permitted if requested via tom@tommeinelt.com before the item has shipped.

• Restocking Fee: Any approved request to modify a produced image is subject to a 50% restocking fee.

3. PAYMENT & TAXES

• Advance Payment: Full payment is required at the time of order placement via credit card, PayPal, or other currently accepted methods.

• Non-Payment: In the event of stopped payments or disapproved charges, we reserve the right to cancel the order. If the order has already shipped, the customer is liable for all collection costs, including reasonable attorney fees, and interest at a rate of 1.5% per month (or the highest rate allowable by law).

• Sales Tax: Customers are responsible for all applicable state, local, or federal sales, use, VAT, excise, and import fees. If these are not collected at checkout and the Company is later required to pay them, the customer agrees to promptly reimburse the Company.

4. COLOR MATCHING & PRODUCT VARIATION

Customers acknowledge that colors seen on a computer monitor or mobile device may differ from the colors of the final manufactured product due to display calibration and material textures. We do not guarantee an exact color match between digital previews and the physical print.

5. DELIVERY & RISK OF LOSS

• Lead Times: Please allow 8–10 weeks for Limited Edition purchases or 1–3 days for retail products to be processed for shipping.

• Transfer of Risk: Title and risk of loss pass to the customer upon our delivery of the item to the carrier.

• Shipping Charges: All shipping, handling, and insurance charges are the responsibility of the customer and are included in the total order amount.

6. DAMAGE & RETURN AUTHORIZATION

Inspect your Fine Art Photography immediately upon receipt. * Reporting Window: Notification of shipping defects or damage must be made within three (3) days of delivery. * Required Proof: You must provide a written claim via email to tom@tommeinelt.com including: 1. A clear photograph of the damage. 2. A photograph of the original crating/packaging. 3. A copy of the shipping receipt.

• Authorization: No returns will be accepted without a Return Authorization Notice (RAN) issued by us. Claims without the original packaging will be denied.

• Replacement Costs: If a replacement is approved, the customer is responsible for the cost of returning the damaged print and the shipping costs for the new replacement print.

7. EGIFT CARDS

• Final Sale: eGift Cards cannot be returned, canceled, or redeemed for cash (except where required by law).

• Security: Lost or stolen eGift Cards will not be replaced without the original purchaser’s confirmation email as proof of purchase. Ownership and risk of loss pass to the purchaser upon our electronic confirmation to the recipient.

8. COPYRIGHT & INTELLECTUAL PROPERTY

All copyrights and trade rights to the Fine Art Photography are expressly reserved to Tom Meinelt Photography.

• No License: The purchase of a print does not involve the sale or license of the Copyright.

• Prohibited Acts: Customers are strictly prohibited from reproducing, scanning, or copying Tom Meinelt Photography in any form.

• Trademark: The artist’s name, signature, and logo are registered trademarks. All rights reserved.

9. LIMITATION OF LIABILITY

To the extent permitted by law, Tom Meinelt Photography’s total liability for any claim related to a product purchase is limited to the actual amount paid for the product. We are not liable for delays or failures in delivery due to causes beyond our control (Acts of God, weather, labor strikes, etc.).
